Welcome to VacationPoolHomes.com (“Company,” “management,” “we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern the use of our vacation rental properties, website, and related services (collectively, the “Services”). By booking and using our properties, you (“Guest,” “you,” or “your”) agree to these Terms. Please read them carefully before booking.

1. CHECK-IN AND CHECK-OUT

  • Check-in time: After 4:00 PM
  • Check-out time: Before 10:00 AM
  • Reservations made within 7 days of arrival may NOT pre-register or check-in after hours. These guests must check-in at the office during regular business hours and present a picture ID and credit card matching the name on the reservation.

2. OCCUPANCY & HOUSE RULES

  • All properties are NON-SMOKING. A $200 cleaning and air restoration fee will be charged for any violation.
  • Maximum occupancy limits (including infants and children):
    • 2 BR: 6 guests
    • 3 BR: 8 guests
    • 4 BR: 10 guests
    • 5 BR: 12 guests
    • 6 BR: 14 guests
  • By state law, occupancy may not exceed posted limits for each home.
  • Quiet hours must be observed to avoid disturbances.

3. PET POLICY

  • Only dog-friendly properties accept dogs with prior approval and payment of a non-refundable pet fee.
  • Unauthorized pets will result in a 20% surcharge on the total reservation cost, and management reserves the right to terminate the rental agreement without a refund.
  • Some properties do not allow pets under any circumstances. Please review the specific property’s pet policy before booking.

4. RESERVATION DEPOSIT & PAYMENT

  • A $220 deposit is required to confirm reservations, applied to the total amount due.
  • The final payment is due 30 days before arrival and will be charged to the card on file unless other arrangements are made.
  • All rates are subject to a 13.5% state and local tax.
  • A one-time cleaning fee applies to all reservations ranging between $170 – $350 depending on the size of the home.

5. PROPERTY PROTECTION FEE

  • A non-refundable $65 Property Protection Fee applies to all reservations.
  • This fee covers up to $400 in accidental damage.
  • Intentional damage or gross negligence is not covered and will result in additional charges. A valid credit card must be on file for damages exceeding $400.

6. DATE CHANGE REQUESTS

  • Changes to a confirmed reservation are subject to availability.
  • We will make reasonable efforts to accommodate changes but cannot guarantee availability.

7. CANCELLATION POLICY

  • Cancellations 30+ days prior to arrival: Forfeit the $220 deposit.
  • Cancellations within 30 days of arrival: No refund.
  • Any modification of a reservation may be considered as a cancellation.

9. OPTIONAL SERVICES & FEES

For the convenience of our guests, we offer a selection of optional services that may be added to your reservation for an additional fee. These services are not included in the standard rental price. All optional services are subject to availability and must be paid in full before activation.

Pool Heating

  • Pool heating is NOT included in the rental price. Guests may choose to add pool heating for an additional fee.
  • Pool heating requires a minimum of three (3) consecutive days.
  • Pricing:
    • Homes: $35.00 per day
    • Townhomes: $25.00 per day
  • Pool heating must be requested and paid for at least 48 hours prior to the desired activation date.
  • Please note that pool heaters may take 24-48 hours to reach the desired temperature, depending on weather conditions. No refunds will be provided for delays in heating due to external factors such as cold weather.
  • Pool heating operates within standard temperature ranges; however, we cannot guarantee specific temperature settings.

BBQ Grill Rental

  • Guests may rent a BBQ grill for personal use during their stay.
  • BBQ grill rental requires a minimum of three (3) consecutive days.
  • Pricing: $25.00 per day.
  • The guest is responsible for cleaning the grill after use. A cleaning fee may apply if the grill is returned in an unclean condition.
  • Use of the BBQ grill must comply with all property safety regulations and local fire codes.

Child Equipment Rentals

For guests traveling with young children, we offer the following rental items for the duration of your stay:

  • Pack & Play: $45.00 (flat fee for the entire stay).
  • High Chair: $45.00 (flat fee for the entire stay).
  • All child equipment rentals are subject to availability and must be requested at least 48 hours in advance.

10. ACCEPTED PAYMENT METHODS

  • We accept Visa, MasterCard, American Express, Discover, Travelers Checks, and Money Orders.
  • Personal checks accepted only for reservations made at least 60 days in advance.
  • Cash is accepted for security deposits at check-in during normal business hours.

11. FLORIDA LANDLORD-TENANT COMPLIANCE

  • This agreement adheres to Florida’s short-term rental regulations, ensuring compliance with landlord-tenant laws that govern property rental agreements.
  • Guests acknowledge that they have no tenant rights under Florida law, as their stay is considered temporary lodging.

12. AMERICANS WITH DISABILITIES ACT (ADA) COMPLIANCE

  • Company follows ADA guidelines where applicable.
  • Guests requiring specific accessibility accommodations should contact management prior to booking to confirm availability.

13. FAIR HOUSING ACT (FHA) COMPLIANCE

  • We adhere to FHA non-discrimination policies, ensuring fair access to accommodations regardless of race, color, religion, sex, familial status, or national origin.
  • Any disputes regarding discrimination should be reported immediately to management.

14. ANTI-FRAUD AND CONSUMER PROTECTION

  • Company complies with state and federal consumer protection laws, ensuring all pricing, fees, and policies are transparently disclosed.
  • Any attempts to commit fraud, including chargeback fraud or misrepresentation of identity, will be prosecuted to the fullest extent of the law.

15. DATA PRIVACY AND SECURITY

16. LIABILITY WAIVER

  • Company is not liable for personal injury, illness, accidents, loss, theft, or damage to personal property, whether occurring inside the Property, on surrounding premises, or in common areas.
  • Guests assume full responsibility for their safety and agree to indemnify, defend, and hold harmless the Company, property owner, property management, agents, employees, contractors, affiliates, and any associated entities from and against any and all claims, demands, liabilities, damages, costs, expenses, or causes of action arising from the Guest’s stay. 
  • Guests shall immediately report any defects, damages, or maintenance issues with the Property within twenty-four (24) hours of check-in. The property management team shall have a reasonable time to inspect and remedy any reported issue.  

17. FORCE MAJEURE

  • Company is not responsible for cancellations, delays, or interruptions due to events beyond our control, including but not limited to natural disasters, pandemics, government regulations, or acts of God.

18. DISPUTE RESOLUTION & ARBITRATION

  • Any disputes arising from this agreement shall be resolved through mandatory binding arbitration in the State of Florida.
  • Both parties waive the right to a jury trial and agree to resolve disputes exclusively through arbitration proceedings, except where prohibited by law.

19. SEVERABILITY CLAUSE

  • If any provision of these Terms & Conditions is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.

20. MODIFICATIONS

We reserve the right to update, amend, or revise these terms at our discretion. Updates will be reflected with a new “Last Updated” Date at the beginning of this document. 

21. ACKNOWLEDGEMENT 

By completing a reservation, the guest acknowledges and agrees to a strict no-refund policy, including in cases of early departure, unused nights, inclement weather, travel disruptions, personal emergencies, or other unforeseen circumstances. The guest acknowledges and agrees to these Terms & Conditions.
